1. Acceptance of Terms

By accessing or using SiteSmoke ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Using the Service includes but is not limited to: scanning websites, creating an account, installing badges, accessing the dashboard, and using any features provided by SiteSmoke.

2. Service Description

SiteSmoke is a web accessibility scanning tool that analyzes websites against WCAG 2.2 standards and maps issues to applicable legal frameworks. The Service provides automated scan results, accessibility scores, compliance badges, and related features.

SiteSmoke is not a legal service. Scan results, scores, legal framework mappings, and any other output are provided for informational purposes only. They do not constitute legal advice, a legal audit, or a guarantee of compliance with any law or regulation. Consult a qualified attorney for legal guidance.

The Service uses automated tools (axe-core) to detect accessibility issues. Automated scanning cannot detect all accessibility barriers. A passing score does not mean your website is fully accessible or legally compliant.

3. User Responsibilities & Authorization

You represent and warrant that you have authorization to scan any website you submit to SiteSmoke. This means you either own the website, operate it, or have been explicitly granted permission by the owner to perform an accessibility scan.

By clicking "Scan my site" and confirming the consent checkbox, you affirm that:

  • You own the website or have explicit permission from the owner to scan it.
  • You will not use the Service to scan websites without proper authorization.
  • You will not use scan results to harass, threaten, extort, or harm website owners.
  • You will not use the Service to conduct competitive intelligence gathering in bad faith.
  • You accept full responsibility for any scans initiated under your account or IP address.

Each scan requires explicit consent confirmation. This consent is recorded with a timestamp for our records.

4. Prohibited Uses

You agree not to use the Service to:

  • Scan websites you do not own or have permission to scan.
  • Conduct denial-of-service attacks or intentionally overload target websites.
  • Circumvent rate limits, authentication, or other security measures.
  • Use scan results to file frivolous or bad-faith legal claims against website owners.
  • Scrape, resell, or redistribute scan data or reports in bulk.
  • Impersonate another person or entity.
  • Violate any applicable law or regulation.

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you are violating these terms.

5. Accounts

Creating an account is optional. Anonymous scans are available with limited features. If you create an account, you are responsible for maintaining the security of your login credentials. You are responsible for all activity that occurs under your account.

You may delete your account at any time from the Settings page. Account deletion removes your personal data, sites, scans, and webhooks. Badges may remain active to avoid breaking embed codes on third-party websites.

Upon account deletion, we retain a minimal audit record for up to 2 years. This record contains only your email address, the URLs you scanned, and consent timestamps. It does not include scan results, screenshots, or any other detailed data. This retention is necessary under our legitimate interest to prevent abuse of the Service and comply with potential legal obligations. Audit records are automatically purged after the retention period.

6. Accessibility Badge

The SiteSmoke accessibility badge is provided for use on websites you own or operate. The badge displays your most recent scan score and links to your verification page on SiteSmoke.

The badge is not a certification, endorsement, or guarantee of accessibility compliance. It indicates that you are actively monitoring your website's accessibility using SiteSmoke. Displaying the badge does not protect you from legal action.

You may not modify the badge to display false information or misrepresent your score.

7. Data & Privacy

Our handling of your data is described in our Privacy Policy, which is incorporated into these terms by reference.

By scanning a website, you acknowledge that SiteSmoke will access and analyze publicly available pages on that website. Scan results, including screenshots of individual elements, may be stored and displayed to you and (for badge verification pages) to the public.

8. Intellectual Property

SiteSmoke, its logo, design, and content are the property of SiteSmoke and its creators. You may not reproduce, distribute, or create derivative works from the Service without our written permission.

Scan reports and results generated for your websites are yours to use, share, and distribute as you see fit.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

SiteSmoke shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Inaccurate scan results or scores.
  • Legal action taken against you based on or despite scan results.
  • Loss of data, revenue, or business opportunities.
  • Downtime, service interruptions, or security breaches.
  • Actions taken by third parties based on your scan results or badge.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or $0 for free-tier users.

10. Indemnification

You agree to indemnify and hold harmless SiteSmoke, its creators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third party's rights — including scanning websites without authorization.

11. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify users through an announcement on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
